Employers in the state of Georgia are protected under the Workers’ Compensation Act. According to the law firm, this means ‘the victim or victim’s family cannot recover damages for pain and suffering or for the ‘full value of the life of the decedent.’” However, there is an exemption for farm laborers.
Siting the Workers’ Compensation exemption as well as an additional carve out for companies with less than three employees, Butler Kahn filed a lawsuit on behalf of the decedent’s two adult sons. The suit argued the employer’s action resulted in the death. Upon receiving the suit, the employer claimed no fault, saying the trailer simply rolled forward. This contradicted the initial police report in which the employer stated he pressed the accelerator in the pickup by accident.
After investigating further, the team at Butler Kahn was able to identify a witness who corroborated the initial report that the employer caused the accident. The case was settled out of court at the request of the clients for the sum of $2,000,000.
